Investment Misconduct Rarely Looks Obvious
It usually looks like a trusted advisor. Someone who came recommended, who returned your calls, who put you into something that you were told “made sense for your situation.”
At some point during your dealings with the advisor, you noticed something that didn’t seem right. Investment losses that seemed out of place. You asked questions and got responses that didn’t quite make sense to you. Maybe the investment firm told you it was “just the market.”
Depending on the circumstances, reasonable volatility and fluctuations in your portfolio can be normal. But sometimes it’s an advisor who steered you into investments that were never appropriate for you, a broker who traded your account without permission, or a firm that buried complaints about that broker instead of acting on them.
Investors who lost $100,000 or more to that kind of misconduct may have grounds to demand accountability.

Courtney Werning is exceptionally professional. She responded to all of my questions promptly and explained every step of the process in great detail. From the very beginning through the final hearing, Courtney and her team were always patient, attentive, and willing to answer my questions while making every effort to understand my situation.
In the days leading up to the hearing, the team invested an extraordinary amount of time and effort preparing documents, gathering evidence, and organizing the case. They worked tirelessly from morning until evening. Every member of the team, including Don Much and Vanessa Villarreal, demonstrated a high level of professionalism and expertise.
In the end, we achieved a successful outcome. Throughout the entire process, it was clear that they genuinely cared about their clients and possessed extensive experience and deep legal knowledge. Courtney Werning, in particular, had a thorough understanding of every piece of evidence and every detail of the case. During the hearing, she displayed outstanding professionalism, remarkable organization, and strong logical reasoning. Her arguments were clear, precise, and persuasive. Committed to you
We Only Represent Investors
Meyer Wilson Werning has built its entire investor claims practice around one mission: fighting for harmed investors and holding Wall Street accountable to Main Street. Our firm does not just dabble in securities law. We are exclusively focused on one thing: representing individual investors against the powerful financial firms that harmed them. Our attorneys, paralegals, and support staff focus exclusively on investor claims, mass torts, and class actions. With more than 75 years of combined experience in securities law, our team brings this extensive knowledge to complex fraud, misrepresentation, and broker misconduct cases.
We have litigated breach of fiduciary duty, unsuitable investment recommendations, unauthorized trading, churning, portfolio over-concentration, and misrepresentation claims against brokerage firms and investment advisers since 1999. We take on fraud cases, elder scams, unregistered private placements, and firms that failed to supervise the brokers responsible for your losses.
We also accept only a limited number of cases at a time, so each client receives the full weight of our focus and resources. And because we work on contingency, you owe us nothing unless we win.
You may have an investment misconduct claim if:
- Your broker or advisor recommended investments that didn’t match your age, risk tolerance, or stated goals
- Trades were made in your account without your authorization
- Your portfolio was over-concentrated in a stock, sector, or asset class
- Your advisor downplayed or failed to disclose investment risks
- You were pressured to invest quickly or promised guaranteed returns
- You were placed in a private placement or alternative investment you still can’t fully explain
- You lost $100,000 or more due to broker or advisor misconduct
What sets us apart
How the Claims Process Works
- You tell us what happened.
A free case evaluation, confidential and with no obligation. - We review the investment activity, correspondence, and other documents.
We examine your statements, the trade history, and the adviser or firm’s regulatory record, and tell you honestly whether you have a claim worth bringing. - We file and litigate.
We pursue your claim and handle it from filing through final hearing. - We work to recover your losses.
On contingency, so no fees or expenses unless we recover money for you.
Clarity Before You Call
Frequently Asked Questions
What types of investment misconduct do you handle?
Breach of fiduciary duty, unsuitable recommendations, unauthorized trading, churning, overconcentration, elder fraud and misrepresentation or omission of material facts by a financial professional. We also handle selling away, unregistered private placements, and failure-to-supervise claims against brokerage firms.
How long do I have to file a claim?
The answer depends on where your claim must be filed and what state law applies.
Depending on the forum, whether that’s FINRA arbitration, AAA, JAMS, or court, each has its own eligibility rules and time limits. On top of that, California’s statutes of limitations for securities and fraud claims may expire well before any forum-specific deadline closes. In some cases, that window can be as short as two to three years.
Because the deadlines vary by forum and the shorter one always controls, there is no one-size-fits-all answer. The only reliable answer is a case-specific one. If you believe something went wrong with your investment, have it reviewed now by an experienced securities lawyer. Do not assume you have time to spare.
Do I have to go to court?
In most cases, no. Investment disputes are typically resolved through arbitration, not court. Depending on your account agreement, that may mean FINRA, AAA, JAMS, or another forum. Arbitration is generally faster and more streamlined than traditional litigation, and in many cases, the agreement you signed when you opened your account makes it the only path available.
What does it cost to hire an investment fraud lawyer?
Nothing up front. We handle all cases on a contingency fee basis. We only get paid our fees and costs if we recover compensation for you.
What can I recover in a claim?
It depends entirely on the facts of your case. The only way to know what you may be entitled to recover is to have your situation evaluated.
Do you handle cases outside California?
Yes. While this page is built for California investors, our firm represents clients nationwide in securities arbitration and litigation.
